Please read these Terms of Service ("Terms") carefully before using OpenBazar.xyz. By accessing or using any part of our platform — including the market directory, seller tools, or API — you agree to be bound by these Terms. If you do not agree, do not use the platform.
1. Who We Are
OpenBazar.xyz ("OpenBazar", "we", "us", or "our") operates a digital directory of physical open-air markets and a suite of SaaS tools designed for street vendors and informal economy participants worldwide. We are not affiliated with, nor a successor to, the former OpenBazaar cryptocurrency protocol.
2. Eligibility
You must be at least 18 years of age to use our platform. By using OpenBazar.xyz, you represent that you are legally capable of entering into a binding agreement and that your use complies with all laws and regulations applicable in your jurisdiction.
3. Description of Services
OpenBazar.xyz currently provides the following services, some of which are in active beta:
- Global Market Directory: A curated, informational database of open-air markets, souks, and bazaars worldwide. Directory data is provided for general reference only and may not reflect real-time conditions, operating hours, or vendor availability.
- QR Snap Pay: A mobile payment tool that facilitates transactions using stablecoin rails (USDC/USDT) and bridges settlement to local fiat currency. This service involves digital asset transfers and is subject to the additional terms in Section 6 below.
- Inventory Lite: An AI-assisted, photo-based inventory tracking tool for market vendors, including WhatsApp-based stock alerts and daily sales summaries.
- Global Shipping API: A shipping integration service connecting vendors to local courier networks for post-sale international delivery, including label generation and customs documentation.
- OpenBazar API: Programmatic access to market directory data for developers. API usage is governed by Section 7 below.
We reserve the right to modify, suspend, or discontinue any service or feature at any time with reasonable notice where practicable.
4. Waitlist & Beta Access
Certain tools are currently in beta and accessible only through our waitlist. By joining the waitlist you provide your email address voluntarily. Joining the waitlist does not guarantee access, create a contract of service, or confer any rights to future features. We may accept or decline waitlist applicants at our sole discretion.
5. Acceptable Use
You agree not to use OpenBazar.xyz to:
- Violate any applicable local, national, or international law or regulation.
- Engage in fraudulent, deceptive, or misleading conduct.
- Transmit unsolicited commercial communications (spam).
- Attempt to gain unauthorized access to our systems, databases, or any third-party network connected to our platform.
- Scrape, harvest, or systematically extract directory data beyond what is expressly permitted by these Terms or the API documentation.
- Upload or transmit malicious code, viruses, or any content that could disrupt or damage the platform.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
Violations may result in immediate suspension of access and, where appropriate, referral to relevant authorities.
6. Payments & Digital Assets (QR Snap Pay)
QR Snap Pay processes transactions using stablecoins (USDC and USDT) bridged to local fiat currency. By using this tool, you acknowledge and agree that:
- Digital asset transactions are generally irreversible. Once a payment is broadcast to the network, it cannot be recalled or reversed by OpenBazar.
- You are solely responsible for the accuracy of wallet addresses and transaction amounts you enter.
- Cryptocurrency and stablecoin usage may be restricted or regulated in your jurisdiction. You are responsible for ensuring your own compliance with local financial regulations, tax obligations, and any applicable licensing requirements.
- Currency exchange rates used for fiat conversion are provided at the time of settlement and may fluctuate. OpenBazar does not guarantee any specific exchange rate.
- OpenBazar acts as a technology intermediary only. We are not a licensed money transmitter, bank, or financial institution. For regulated financial services, consult a licensed provider in your jurisdiction.
7. API Usage
Access to the OpenBazar API requires registration for an API key. By using the API you further agree to:
- Use the API only for lawful purposes and in accordance with the published API documentation.
- Not resell, sublicense, or redistribute raw API data as a standalone data product without written permission from OpenBazar.
- Respect any rate limits we impose. Circumventing rate limiting mechanisms is prohibited.
- Attribute OpenBazar.xyz as the data source in any application or publication that uses our data.
We reserve the right to revoke API access for violations of these Terms without prior notice.
8. User-Submitted Content
If you submit content to OpenBazar.xyz (including market listings, vendor profiles, or feedback), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content for the purpose of operating and improving the platform. You represent that you have the right to submit such content and that it does not infringe any third-party rights.
9. Third-Party Services
Our platform integrates third-party services including Google AdSense (advertising), Google Analytics (usage data), courier networks (shipping integrations), and stablecoin payment networks. Your use of these embedded services is also governed by the respective third-party's own terms of service and privacy policies. We do not control and are not responsible for the conduct or content of third parties.
10. Intellectual Property
All content on OpenBazar.xyz — including the brand name, logo, platform design, written content, and compiled market data — is the intellectual property of OpenBazar.xyz or its licensors and is protected by applicable copyright, trademark, and database laws. Nothing in these Terms grants you any right to use our trademarks, trade names, or other brand features without our express written consent.
11. Disclaimers
The platform and all services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that:
- Directory data is accurate, complete, or current.
- The platform will be uninterrupted, error-free, or secure.
- Beta tools will meet your specific operational requirements.
Market information is curated for general discovery purposes. Always verify local operating conditions, vendor details, and regulatory requirements directly before making commercial decisions.
12. Limitation of Liability
To the maximum extent permitted by applicable law, OpenBazar.xyz and its founders, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or business opportunities — arising out of or related to your use of the platform, even if advised of the possibility of such damages. Our total aggregate liability to you for any direct damages shall not exceed the greater of USD $50 or the fees paid by you to OpenBazar.xyz in the three months preceding the claim.
13. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which OpenBazar.xyz is registered, without regard to its conflict of law provisions. Any disputes you cannot resolve informally should first be submitted to us in writing at hello@openbazar.xyz. We will attempt to resolve disputes in good faith within 30 days. If unresolved, disputes shall be submitted to binding arbitration or the competent courts of our registered jurisdiction, as applicable.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. If changes are material, we will notify waitlist subscribers by email. Continued use of the platform after changes become effective constitutes acceptance of the revised Terms.
